These Terms of Service govern your use of trei and trellismetabolic.com. Companion document: Privacy Policy.
By downloading, accessing, or using trei or trellismetabolic.com, you agree to these Terms of Service. If you do not agree, do not use the service.
If you use trei on behalf of another person (for example as a parent or legal guardian of an admitted minor), you represent that you have authority to bind that person and to consent as these terms and the Privacy Policy require.
1. Operator and notices
trei is operated by BariAccess, LLC (“BariAccess,” “we,” “us,” or “our”). The clinic cohort named on this site is Bariatric Associates (V.E. Andrei MD Bariatric Associates, P.A.) (the “named clinic”). trellismetabolic.com is a product home for trei, not a separate company.
BariAccess is not your treating provider. The named clinic, not BariAccess, provides clinical care when you are an admitted patient of that clinic. Nothing in these terms creates a physician–patient relationship with BariAccess, LLC.

Legal notices to BariAccess must be sent to the notice and correspondence address above, with a copy by email to Valeriu@bariaccess.com, and are effective on receipt if delivered by overnight courier or certified mail, or on the business day after an email is sent if no bounce is received.
2. Eligibility and territory
trei and trellismetabolic.com are offered for use in the United States. We do not offer the service as directed to residents of the European Union, the European Economic Area, the United Kingdom, or other non-U.S. jurisdictions.
You must be able to form a binding contract with BariAccess. The service is not directed to children under 13. Self-serve clinical signup on this website is not available to a person under 18. Clinical admission of a person under 18 requires guardian authority through the named clinic. See §16.
We may refuse, suspend, or limit access where law, store rules, clinic admission, payment, or safety require it.
3. The service
trei is a GLP-1 wellness companion. Displayed name: TREI-Confidence Between Doses.
trei helps you see sleep, activity, heart rate, body measures, and related wellness information — including, if you connect a device, wearable-derived composites judged by BariAccess formulas — so you can stay oriented between doses and share accurate numbers with your own clinician. Connecting a wearable is optional. The app still works for assigned programs without a device.
The service includes: the trei iOS and Android applications; trellismetabolic.com (product home, activation, and membership checkout); assigned wellness programs, check-ins, and education; practice messages after clinic admission; push notifications you allow; the in-app assistant (text and voice); optional wearable connection; optional lab-report upload; and optional meal-photo analysis.
trei does not diagnose, treat, cure, or prevent any disease or medical condition. It does not prescribe, set injection day, change medication, dose, titration, or injection timing. It is not a medical device. Interpretation of results and any change to prescribed treatment belong to a licensed clinician. See §5.
Downloading the app does not create an account. Activation and, when payment is due, checkout occur on trellismetabolic.com. Clinic features unlock only after staff admission by the named clinic.
You are responsible for the device, operating system, connectivity, and sign-in method you use. We may change, suspend, or discontinue features. We do not promise uninterrupted or error-free operation.
4. Identity, accounts, and security
You may sign in with Apple, Google, or email through Microsoft Entra External ID. You do not need a Microsoft account.
Name and telephone used during activation help locate a candidate. They are not authentication credentials. Staff of the named clinic control clinical admission.
You must keep your sign-in credentials and device access under your control. You are responsible for activity that occurs under your account unless it results from our failure to safeguard the service. Tell us promptly at Valeriu@bariaccess.com if you believe your account or device has been compromised.
We may require re-authentication, revoke a session, or suspend an account to protect you, other users, the named clinic, or the service.
5. Safety, medical limitation, and emergencies
Practice messages and push notifications are not emergency services, are not guaranteed timely, and follow the named clinic’s approved escalation procedure.
For emergencies, call 911 (or your local emergency number) or go to the nearest emergency room. If you cannot reach your clinician and you believe you are in danger, use emergency services. Do not use trei, in-app messages, push notifications, or the in-app assistant for emergency care.
You must not rely on trei as a substitute for professional medical advice, diagnosis, or treatment. Seek the named clinic or another licensed clinician for clinical decisions.
trei is a wellness companion. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Nothing displayed in trei — including wearable data, composites, education, check-ins, lab-report or meal-photo analysis, or assistant replies — is medical advice or a clinical order.
6. Membership, payment, cancellation, and refunds
Payment, when due, occurs on trellismetabolic.com only, through Stripe, Inc. There is no in-app purchase and no App Store or Google Play billing for membership.
Membership state is recorded by BariAccess systems on Microsoft Azure. Checkout uses email and payment information only. We do not send height, weight, drug, diagnosis, medical-record numbers, or other protected health information to Stripe.
Prices, taxes, and the then-current membership offer are shown at checkout. Unless the checkout page says otherwise, consumer membership is billed periodically and may be cancelled at any time, with the cancellation taking effect at the end of the then-current paid period. You continue to have paid access until that period ends, unless law requires otherwise.
Chargebacks, failed payments, or unpaid amounts may suspend membership. Refunds, if any, follow the checkout terms displayed at purchase and applicable law. If a charge was unauthorized, contact Valeriu@bariaccess.com and use Stripe’s dispute process.
You authorize Stripe and BariAccess to charge the payment method you provide for amounts you incur.
Clinic-sponsored or complimentary membership, if the named clinic or BariAccess extends that offer to you, is governed by that offer. It does not convert trei into clinical care by BariAccess.
7. Wearables and third-party health platforms
Connecting a wearable or health platform is optional and happens in the trei app after clinic admission — not on trellismetabolic.com.
Spike Technologies Inc. is the courier for wearable and connected-health data. BariAccess formulas remain the judge. trei describes composites in ordinary words. It does not present vendor wellness scores (including vendor `*_score` fields) as trei conclusions.
You may connect these sources: Oura Ring, Garmin, Fitbit, Polar, Whoop, Withings, Freestyle Libre, Google Fit / Google Health, Apple Health (HealthKit), Health Connect, and Samsung Health. Availability of a given source on your phone depends on your device and that provider’s terms. We do not write data back to Apple Health or Health Connect.
Connection uses the provider’s consent flow (OAuth) or the native health platform on your phone. You can disconnect a source in the app and can revoke access in the provider’s or phone’s settings. Disconnecting stops new collection from that source. Previously received data is handled as the Privacy Policy describes.
Wearable and HealthKit / Health Connect data are not used for advertising, sale, or cross-context behavioral advertising. We will not train AI models on Oura data. See the Privacy Policy §§6 and 9.
Your use of a third-party device or platform is also governed by that provider’s terms and privacy notice. We are not those providers. Listing a vendor does not transfer responsibility for trei away from BariAccess, LLC.
8. In-app assistant, voice, photos, and uploads
trei includes an in-app assistant for text and, if you allow the microphone, voice. Assistant replies are wellness support, not medical advice, not a diagnosis, and not a change to medication or dose. The assistant can be wrong. Check important facts with your clinician.
You may upload a lab report or a meal photo for analysis. Those features do not diagnose, treat, or change medication. You must not upload another person’s information unless you have authority to do so.
Microphone, camera, notification, and health-data permissions are optional except where a specific feature cannot run without them. You may deny or later revoke those permissions in device settings. The rest of the service continues where it does not depend on the denied permission.
9. Practice messages and notifications
If you are clinic-admitted, staff of the named clinic may send you practice messages in trei. You may receive push notifications if you allow them.
Those channels are not emergency services and are not guaranteed timely. Expected response and escalation follow the named clinic’s approved procedure.
You may turn off push notifications in device settings. Turning them off does not cancel membership and does not delete your account.
10. User content and feedback
You retain rights in content you submit (for example check-ins, journal entries, messages to the practice, photos you upload, and voice you record). You grant BariAccess a limited, worldwide, non-exclusive license to host, process, display, and transmit that content solely to operate trei, to provide it to the named clinic when you are admitted, and as the Privacy Policy allows.
That license ends when we delete the content from our systems, except for copies retained as law, HIPAA, payment records, or a legal hold require, and except for de-identified or aggregated information that cannot reasonably identify you.
If you send ideas, comments, or feedback about trei, you grant BariAccess a perpetual, irrevocable, royalty-free license to use that feedback to operate and improve the service, without obligation to you. Do not send feedback you do not want used that way.
You represent that you have the right to submit the content you submit, and that it does not violate law or these terms.
11. Acceptable use
You may use trei only for its intended wellness-companion purpose, in compliance with these terms and law.
You must not:
- attempt unauthorized access, probe, or interfere with the service;
- reverse engineer except as law allows;
- scrape, harvest, or bulk-export data except through a privacy request we honor;
- submit another person’s information without authority;
- use the service for emergencies;
- present vendor wellness scores as trei conclusions;
- use trei to diagnose, treat, or change medication;
- upload malware, or content that is unlawful, infringing, or harassing;
- impersonate another person, or evade suspension;
- resell, sublicense, or commercially exploit the service except as we agree in writing;
- use automated means to create accounts or send messages.
We may suspend or terminate access for violation, non-payment, safety, legal duty, or clinic-admission changes.
12. Intellectual property
trei, trellismetabolic.com, BariAccess formulas, composites, software, documentation, and related marks (including trei / TREI and BariAccess) are owned by BariAccess, LLC or its licensors. Third-party marks (including device and platform names) are the property of their owners.
We grant you a limited, revocable, non-exclusive, non-transferable license to use the service for your personal, non-commercial use while your membership (or permitted clinic-admitted use) is in good standing. No other license is granted. You may not copy, modify, distribute, or create derivative works except as law allows.
13. Vendors and third-party terms
Processors used to operate trei:
- Microsoft Azure and Microsoft Entra External ID (hosting, identity, operational telemetry);
- Apple (Sign in with Apple, App Store distribution, HealthKit, push delivery on iOS);
- Google (Sign in with Google, Play distribution, Health Connect / Google Health, push delivery on Android);
- Spike Technologies Inc. (wearable and connected-health courier; lab-report and nutrition analysis);
- Stripe, Inc. (payment on trellismetabolic.com only);
- Microsoft Azure AI / speech services (in-app assistant text and voice, under BariAccess’s configuration).
Health values, message bodies, and identifiers are not placed in ordinary analytics.
Your use of Apple, Google, Spike, Stripe, or a device maker is also subject to that party’s terms. Those parties are not parties to these terms except as §14 says for Apple.
14. Apple App Store and Google Play
14.1 Apple
If you download trei from the Apple App Store, you acknowledge:
- these terms are between you and BariAccess, LLC, not Apple;
- Apple has no obligation to provide maintenance or support for trei;
- if trei fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for trei; to the maximum extent permitted by law, Apple has no other warranty obligation;
- Apple is not responsible for claims relating to trei or your possession or use of trei, including product-liability claims, failure to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar law;
- in the event of a third-party claim that trei or your possession and use of trei infringes that third party’s intellectual property rights, BariAccess, not Apple, is solely responsible for investigation, defense, settlement, and discharge of that claim, as required by these terms;
- you represent that you are not located in a country subject to a U.S. government embargo, or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties;
- you must comply with applicable third-party terms of agreement when using trei;
- Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
HealthKit data, if you grant access, is used only to provide trei’s wellness-companion functions as described in the Privacy Policy. It is not used for advertising or other use-based data mining.
14.2 Google Play
If you download trei from Google Play, these terms are between you and BariAccess, LLC, not Google. Google is not responsible for trei, for support, or for claims arising from your use of trei. Health Connect and Google Health data, if you grant access, are read-only for trei’s disclosed wellness-companion purposes and are not used for advertising.
15. Privacy
Access, correction, export, and deletion: https://trellismetabolic.com/privacy/choices. Account deletion, including after the app is uninstalled: https://trellismetabolic.com/account-deletion.
The Privacy Policy at https://trellismetabolic.com/privacy describes how BariAccess, LLC handles information when you use trei and trellismetabolic.com, including HIPAA (45 C.F.R. Parts 160 and 164) and California CCPA/CPRA (Cal. Civ. Code §§ 1798.100 et seq.).
16. Minors and research
trei and trellismetabolic.com are not directed to children under 13. We do not knowingly collect personal information from a child under 13 (COPPA, 15 U.S.C. §§ 6501–6506; 16 C.F.R. Part 312).
This site does not offer a self-serve under-18 clinical signup. A person under 18 cannot create a clinical trei membership by completing a form on this website.
Clinical admission of a person under 18 requires guardian authority through the named clinic. Staff of the named clinic must complete that admission. The parent or legal guardian must have authority to consent. Store age ratings and “restrict minor access” settings may further limit who can download the app.
If we learn that a child under 13 used the service, or that a person under 18 obtained a clinical signup without guardian authority, we may suspend or delete the account and related information as the Privacy Policy describes.
Ordinary product use does not authorize research or publication. Quality improvement and operations are not a blanket research authorization. Any future research or publication requires a separate legal, privacy, and clinical path (including IRB review or a documented determination where applicable) and, when required, a separate authorization.
17. Electronic communications
By using trei or trellismetabolic.com, you consent to receive notices, agreements, disclosures, and other communications from us electronically, including by email to the address associated with your account, by posting on trellismetabolic.com, or in the app. Electronic notices satisfy any legal requirement that notices be in writing, unless a statute requires otherwise (including certain legal notices under §1).
You may withdraw consent to non-essential marketing email (we do not use wearable or health data for advertising). Transactional, membership, security, and legally required notices may continue as law allows.
18. Disclaimers
TREI IS A WELLNESS COMPANION. IT IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARIACCESS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND THE NAMED CLINIC COHORT DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT PRACTICE MESSAGES, PUSH NOTIFICATIONS, OR ASSISTANT REPLIES WILL BE TIMELY, COMPLETE, ACCURATE, OR SUITABLE FOR EMERGENCIES; THAT WEARABLE DATA, HEALTHKIT OR HEALTH CONNECT DATA, LAB-REPORT OR PHOTO ANALYSIS, OR COMPOSITES WILL BE ACCURATE OR CONTINUOUS; OR THAT THE SERVICE WILL MEET YOUR HEALTH GOALS.
NOTHING IN TREI IS MEDICAL ADVICE. TREI IS NOT A MEDICAL DEVICE. THE NAMED CLINIC, NOT BARIACCESS, PROVIDES CLINICAL CARE WHEN YOU ARE AN ADMITTED PATIENT OF THAT CLINIC.
THIRD-PARTY DEVICES, PLATFORMS, AND NETWORKS ARE OUTSIDE OUR CONTROL. THEIR AVAILABILITY AND ACCURACY ARE NOT WARRANTED.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS. IN THOSE JURISDICTIONS, DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED.
19. Limitation of liability (liability caps)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARIACCESS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS; OR FOR THE COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY, AND WHETHER THE THEORY IS CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF BARIACCESS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS ARISING OUT OF OR RELATED TO TREI, TRELLISMETABOLIC.COM, OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
(a) THE AMOUNTS YOU PAID TO BARIACCESS, LLC FOR TREI IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE CLAIM; OR
(b) ONE HUNDRED U.S. DOLLARS (US $100).
These caps do not apply to: (i) our fraud or willful misconduct; (ii) gross negligence to the extent New Jersey law does not allow it to be limited; (iii) liability for death or personal injury caused by negligence where a statute forbids limitation; (iv) your payment obligations; or (v) any liability that applicable law, including a non-waivable consumer, HIPAA, or CCPA provision, does not allow to be limited.
The named clinic’s professional liability for clinical care, if any, is not governed by this cap. These terms govern use of trei and the website, not a medical-malpractice claim against a treating clinician.
20. Indemnity
You will defend, indemnify, and hold harmless BariAccess, LLC and its officers, directors, and employees from claims, damages, losses, and reasonable legal fees arising out of: (a) your misuse of trei; (b) your violation of these terms or law; (c) information you submit that you were not authorized to submit; or (d) a dispute between you and a third party (including a device maker or sign-in provider) that is not caused by our willful misconduct.
21. Informal resolution, arbitration, and class waiver
21.1 Informal resolution
Before filing a claim, you and BariAccess must try to resolve the dispute informally. Send a written notice to the address in §1 describing the claim and the relief sought. We will try to resolve it within 30 days of receipt. Either party may then proceed under §21.2, unless §21.4 applies.
21.2 Binding individual arbitration
Except for the claims in §21.4, any dispute, claim, or controversy arising out of or relating to these terms, trei, or trellismetabolic.com — including formation, interpretation, performance, breach, termination, and validity of the arbitration agreement — will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by this §21.
The Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs this agreement. The arbitrator may award any relief available in court to an individual, but may not award relief that affects other users.
The seat of arbitration is Essex County, New Jersey. Hearings may be by telephone or video, or in person in Essex County, New Jersey, as the AAA rules and the arbitrator allow.
21.3 Class and representative waiver
YOU AND BARIACCESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING.
If this class waiver is found unenforceable as to a particular claim, that claim must proceed in court, and the remainder of this §21 still applies to the rest.
21.4 Exceptions (court)
Either party may: (a) bring an individual claim in small-claims court in Essex County, New Jersey, or in the county of your U.S. residence, if the claim qualifies; (b) seek temporary or injunctive relief in court to protect intellectual property or unauthorized access; or (c) bring a claim that applicable law forbids from being arbitrated.
HIPAA complaints to HHS OCR, and CCPA or COPPA rights that a statute says must remain available, are not displaced by this §21.
21.5 Opt out
You may opt out of arbitration by sending written notice to the address in §1 within 30 days after these terms first apply to you, with your name, the email used for trei, and a clear statement that you opt out of arbitration. If you opt out, §22 (governing law and venue) still applies, and disputes go to the courts named there.
21.6 Survival
This §21 survives termination of these terms and of your use of trei.
22. Governing law and venue
These terms, and any dispute arising out of trei or trellismetabolic.com, are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, and by the Federal Arbitration Act as to §21.
If a claim proceeds in court under §21.4 or after a valid arbitration opt-out, exclusive venue and jurisdiction lie in the state courts located in Essex County, New Jersey, or in the United States District Court for the District of New Jersey, Newark vicinage, and you consent to those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Mandatory United States federal law (including HIPAA, COPPA, and the FAA) and, for California residents, the CCPA, still apply where they confer non-waivable rights.
23. Export and force majeure
You may not use or export trei except as U.S. export-control and sanctions laws allow. You represent that you are not a prohibited or restricted party under those laws.
We are not liable for delay or failure caused by events beyond reasonable control, including outages of Apple, Google, Spike, Stripe, Azure, or your device or network, or by law, clinic closure, or emergency.
24. Changes, termination, and miscellaneous
We may update these terms by posting the new version at https://trellismetabolic.com/terms and updating the effective date at the top of this page. The posted version controls from that effective date. If you continue to use the service after that date, you accept the updated terms, except that a material change to §21 will not apply to a dispute you already noticed under §21.1 before the change.
You may stop using trei at any time. You may request account deletion at https://trellismetabolic.com/account-deletion and as the Privacy Policy describes. We may terminate these terms or your access as §11 allows. Sections 10, 12, 15, and 18–24 survive termination.
These terms are the entire agreement between you and BariAccess, LLC about trei and trellismetabolic.com. They supersede prior or contemporaneous agreements on that subject. If a provision is unenforceable, it is modified to the minimum extent needed, or severed, and the rest remains in effect. You may not assign these terms without our consent. We may assign them to an affiliate or successor. Waiver must be in writing. Headings are for convenience only. “Including” means “including without limitation.”
Nothing in these terms creates a physician–patient relationship with BariAccess, LLC, or makes BariAccess the named clinic.
